Class action lawsuits by customers against Apple in the United States are nothing new. When serious problems arise with the iPhone company’s hardware and software, users often band together to demand compensation through specialized law firms. This is now also the case with the first generation of AirPods Pro: an annoying clicking problem that has been known since at least 2020 has now led to a new class action lawsuit against Apple in California. The lawsuit was filed a few weeks ago United States District Court for the Northern District of California Presented and admitted that a total of three Apple customers had this problem – and are now looking for others living in the United States who had the same experience.

unpleasant noise
The crack in the AirPods Pro was apparently related to a contamination issue on the AirPods Pro 1’s active noise cancellation (ANC) microphone. Apple already had that too Accepted in a supporting documentThen “cracking and static noise” may occur. Apple says, “Occasionally, foreign objects or earwax may accumulate in the ear.” But this should also continue Possible Software Problems Which Apple wanted to fix with a firmware update.
In practice, the problem with the second generation plug, which currently costs 280 euros, became noticeable with normal wear: suddenly there was a crack. These can also be unpleasantly loud and make use impossible – sometimes it helps to remove the AirPods Pro and put them back in your ear. In some cases the problem recurred later. A model on the MAC&I editorial team also displayed this behavior. Cleanliness helped here, but it happened sporadically. The error was actually only resolved by switching to the new AirPods Pro 2, where Apple apparently screwed up the microphone cover.
sell for at least three years
The class action lawsuit now says that Apple has already acknowledged the “audio defects” of the AirPods Pro 1. Supporting documents are cited in the question. However, Apple continued to sell the device – from October 2019 to September 2022. “Reasonable customers like Plaintiff would not have purchased the AirPods Pro 1 if they had known that Apple’s representations of audio functionality and quality were false and misleading,” the suit says. , The plaintiffs come from the states of Texas, Ohio and Pennsylvania. As mentioned, the purpose of this is to receive compensation from Apple.
According to the plaintiffs, the total amount of claims exceeds $5 million and the potential class action lawsuit could affect more than 100 people. It is still unclear whether the plaintiffs will succeed in their goal of turning the case into a class action lawsuit – that is for the responsible court to decide. Apple could then face fines in the one to three-digit million range, as the AirPods Pro 1 have sold well. The company has not yet commented on the lawsuit. Such proceedings often end with out-of-court settlements in which Apple – without admitting any legal liability – agrees to pay damages, as well as legal fees.
