TikTok will pay for concert recordings in the future

At concerts, it has long been common for fans to record video snippets of their bands and share them on social networks. TikTok should now pay for videos in its community.

The general terms and conditions of the organisers usually prohibit visitors from filming scenes or songs and distributing them on the Internet. However, very few people stick to this. Cultural companies sometimes try to inform guests personally about the ban and, if necessary, delete the recording again for copyright reasons. The notice or prohibition of recording the performance is sometimes also recorded in the agreement with the publisher, for example, a theatre may perform a play.

The Society for the Management of Organisers’ Rights (GWVR) is now taking a different approach: According to the dpa, it has entered into a license agreement with the short video portal TikTok. The portal should pay a flat-rate for the recording of events, GWVR managing director Johannes Ulbricht told the dpa. However, only organisers who are also members of the society benefit from this.

GWVR is a service provider for organisers that allows its members to share in the income generated from concert recordings. The company therefore exercises the organiser’s subsidiary copyright rights. It is a subsidiary of the Hamburg-based Federal Association of the Concert and Event Industry. GWVR grants licences on behalf of its members to rights exploiters such as streaming services, radio or television stations or record producers. The licence fee is then distributed to the members.
