Thomas Fuchs, the Hamburg Commissioner for Data Protection and Freedom of Information (HMBBFDI), has already imposed sanctions in 14 cases as of July of the current year. This is significantly higher than in previous years. The number of administrative offenses this year is already significantly higher than in previous years. Eight procedures were completed throughout the year in 2023 and 15 in 2022.

Stores hotel ID card data
The fines total 130,000 euros, Hamburg data protection official says. Those sanctioned include a hotel and two police staff. Violations of the General Data Protection Regulation (GDPR) include secret bathroom recording in a private context, failure to delete, late information or security gaps in customer service systems.

A company in the advertising industry had to pay 11,500 euros because it did not comply with its deletion obligations. Representatives point out that the company’s IT systems also had technical security flaws. A hotel cost 16,000 euros for collecting and storing ID card data without a legal basis.
Neighbor filmed in the bathroom
Other security flaws also led to fines. Two companies whose support ticket systems were vulnerable paid a total of 45,000 euros. “A logistics company paid 32,000 euros due to incorrect disposal of delivery lists, and an online retailer paid 6,000 euros due to a significant delay in reporting a data breach,” adds Fuchs.
Two members of the police were also targeted. The commissioner prosecuted them because they had queried official databases for private purposes.
Fuchs also prosecuted private individuals: “In one case, a man followed his neighbor and made a video of her in the bathroom,” the statement said. Five people had also photographed or saved pictures of other people without their consent.
